1. Eligibility: The Sweepstakes (the "Sweepstakes") is open only to legal residents of the United States who sign up at www.poppyseedplay.com. Entrants must be 18 years of age or older as of their date of entry in this promotion in order to qualify. Poppyseed Play's employees, its subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees' immediate family and/or those living in the same household of Employees are ineligible to participate in the Poppyseed Play Email Sweepstakes.
   
   
2. Sponsorship. The sponsor is Poppyseed Play (“Sponsor”), located at PO Box 4626; Tampa, FL 33677.
   
   
3. Agreement to Rules: By participating in the Sweepstakes, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. Additionally, you agree to accept the decisions of Poppyseed Play as final and binding in all matters relating to the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws.
   
   
4. Sweepstakes Period: Entries will be accepted online starting on or about September 9, 2024, at 12:00 AM ET and ending November 4, 2024, at 11:59 PM ET (“Entry Period”). All online entries must be received within the specified Entry Period. All times are in Eastern Time (GMT-05:00). To be eligible for the Sweepstakes, entries must be received within the specified Entry Period.
   
   
5. How to Enter: To participate in the Sweepstakes, submit an entry using the online form provided on this site. To be eligible to win, your entry must meet all specified requirements. Incomplete entries or those that do not adhere to the rules and specifications may be disqualified at Poppyseed Play's sole discretion. Each participant may enter only once and must provide the requested information. Multiple entries using different email addresses, identities, or devices to circumvent the rules are prohibited. Any use of fraudulent methods or attempts to circumvent the rules may result in disqualification at Poppyseed Play's sole discretion.
   
   
6. Prizes: The Winner of the Poppyseed Play Email Sweepstakes (the “Winner”) will receive a $200 store credit to Poppyseed Play and to be used at www.poppyseedplay.com. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The prize is non-transferable. The Winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all local, state, and federal taxes. The Winner shall not transfer assignment of the prize to others nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the Sponsor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law.
   
   
7. Odds: The odds of winning are based on the total number of eligible entries received.
   
   
8. Winner Selection and Notification: The Winner of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor. Winner will be notified via email to the address provided at the time of entry within five (5) days following the selection. Poppyseed Play shall have no liability for a winner's failure to receive the notification due to spam, junk email, or other security settings, or for the provision of incorrect or non-functioning contact information. If a selected winner cannot be contacted, is ineligible, fails to claim the prize within seven (7) days from the time the award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate winner selected. Receipt of the prize is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN THE WINNER'S DISQUALIFICATION FROM THE SWEEPSTAKES, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering this Sweepstakes, you acknowledge that Poppyseed Play, its agents, and its respective licensees, successors, and assigns have the right, where permitted by law, to use, print, publish, broadcast, distribute, and otherwise exploit your entry, including but not limited to your name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information. This use may be worldwide, in any media now known or hereafter developed, in perpetuity, for purposes including news, publicity, trade, advertising, public relations, and promotional activities, without any further notice, review, or compensation.
   
   
10. Terms: Poppyseed Play reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes if a virus, bugs, unauthorized human intervention, fraud, or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such cases, Poppyseed Play may select recipients from all eligible entries received before and/or after the action taken. Poppyseed Play also reserves the right, at its sole discretion, to disqualify any individual who tampers with or attempts to tamper with the entry process, the operation of the Sweepstakes or website, or violates these Terms & Conditions. To maintain the integrity of the Sweepstakes, Poppyseed Play may void votes for reasons including, but not limited to, multiple entries from the same user from different IP addresses, multiple entries from the same computer exceeding the allowed limits, or the use of bots, macros, scripts, or other technical means for entering. Any attempt to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may constitute a violation of criminal and civil laws. Limitation of Liability: By entering the Sweepstakes, you agree to release and hold harmless Poppyseed Play, its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not. This includes, but is not limited to:
    
    (i) Your participation in the Sweepstakes and/or acceptance, possession, use, or misuse of any prize or any portion thereof.
    (ii) Technical failures of any kind, including but not limited to malfunctions of any computer, cable, network, hardware, or software.
    (iii) The unavailability or inaccessibility of any transmissions or telephone or Internet service.
    (iv) Unauthorized human intervention in any part of the entry process or the Sweepstakes.
    (v) Electronic or human errors that may occur in the administration of the Sweepstakes or the processing of entries.
    
    
12. Disputes: This Sweepstakes is governed by the laws of the United States and the state of Florida, without regard to conflict of law principles. By participating in this Sweepstakes, you agree that any disputes that cannot be resolved between the parties, and any causes of action arising out of or connected with this Sweepstakes, will be resolved individually, without resorting to any form of class action, exclusively before a court located in Florida with proper jurisdiction. In any such dispute, you agree that you will not be entitled to, and hereby waive all rights to claim, punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than actual out-of-pocket expenses (i.e., costs associated with entering the Sweepstakes).
